The terms "we", "us" and "our" refer to locaf. locaf operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). locaf is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your place of residence. To use the Services or purchase any of the products we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You guarantee that all the information you provide in our store is correct, current, and complete. You are solely responsible for maintaining the security of your account credentials and for all of your account activity.

SECTION 2 - OUR PRODUCTS

We sell designs, posters, and postcards. We have made every effort to provide an accurate representation of our products in our online store. However, please note that colors or product appearance may differ slightly from how they appear on your screen due to your device's settings, display configuration, or screen type. All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time.

SECTION 3 - FORMATION OF CONTRACT AND ORDERS

The presentation of products in our online store does not constitute a legally binding offer, but rather an invitation to place an order.

When you place an order by clicking the checkout button, you are making a binding offer to purchase the selected items. A legally binding purchase contract is only formed when we explicitly accept your order by sending an order confirmation email or by dispatching the goods to you within a reasonable timeframe.

Your purchases are subject to return or exchange in accordance with our statutory Cancellation & Return Policy. Purchases made through our store are intended for personal or household use and not for commercial resale.

SECTION 4 - PRICES AND BILLING

Prices are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email.

VAT Notice: As a small business (Kleinunternehmer) pursuant to § 19(1) of the German Value Added Tax Act (UStG), value-added tax is neither calculated nor displayed on invoices. Posted prices do not include shipping and handling charges, which will be added at checkout.

You agree to provide current, complete, and accurate purchase and payment information for all transactions made at our store.

SECTION 5 - SHIPPING, DELIVERY, AND RISK OF LOSS

Delivery times are estimates only. We are not responsible for delays completely outside of our control.

Contrary to standard templates, if you are purchasing as a consumer ( $B 2 C$ ), the risk of accidental loss, damage, or destruction of the goods passes to you only when the goods are delivered to you or when you enter into default of acceptance. We bear the transit risk for all deliveries to consumers.

Our Services, including but not limited to all text, artwork, illustrations, designs, posters, postcard layouts, images, and graphics, are owned by locaf or its licensors and are protected by applicable copyright and intellectual property laws.

These Terms permit you to use the Services and purchase items for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, or resell any artwork or products purchased from locaf without our express, prior written consent.

SECTION 7 - OPTIONAL TOOLS AND THIRD-PARTY LINKS

We may provide you with access to third-party tools or include hyperlinks to websites operated by third parties (such as integrated social media buttons). We do not control or monitor these external services. We provide access to such tools "as is" and "as available" without any warranties. Any use of optional tools or third-party links is entirely at your own risk.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

Our store is hosted by Shopify International Limited. Shopify provides the e-commerce infrastructure that allows us to offer our products to you. However, any sales contract is made directly between you and locaf. Shopify is not a party to the contract and is not responsible for any transactions, product issues, or liabilities arising from your purchases with locaf.

SECTION 9 - FEEDBACK AND REVIEWS

If you submit or post product reviews, comments, or suggestions (collectively, "Feedback"), you grant us the right to display, edit, or copy this feedback for use in connection with our store operations. We have no obligation to maintain feedback in confidence or pay compensation for it. You guarantee that your feedback will not contain unlawful material or violate the rights of any third party.

SECTION 10 - PRIVACY POLICY

All personal information collected through your use of the Services is handled strictly in accordance with our Privacy Policy.

SECTION 11 - WARRANTY RIGHTS (STATUTORY RIGHTS)

If you are a consumer in the EU, you have full statutory warranty rights (Gewährleistung) under German law for any defective or non-compliant goods. If a poster or postcard arrives damaged, misprinted, or faulty, you are entitled to statutory remedies (repair, replacement, or a refund depending on the defect). The standard statutory warranty period is two years from the delivery of the goods.

SECTION 12 - LIMITATION OF LIABILITY

We are liable without limitation for damages caused by intent or gross negligence, in cases of malicious concealment of defects, for claims under the German Product Liability Act (Produkthaftungsgesetz), and for injury to life, body, or health.

For slight negligence, we are only liable if an essential contractual duty (Kardinalpflicht) is breached—which is an obligation indispensable for the proper execution of the contract and upon which you routinely rely. In such cases, our liability is strictly limited to the typical, foreseeable damage.

SECTION 13 - PROHIBITED USES

You may use the Services for lawful purposes only. You are prohibited from using the site or its content to violate any regulations, infringe upon our intellectual property rights, transmit viruses, or scrape data using automated tools (such as AI bots or crawlers) without our written authorization.

SECTION 14 - SEVERABILITY AND GOVERNING LAW

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, the remaining provisions will remain in full force and effect.

These Terms of Service and any purchase contracts shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of residence.

The European Commission provides an online dispute resolution platform for consumers, accessible at: https://ec.europa.eu/consumers/odr/. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
